Please read these terms of use carefully before you start to use the site. By using our site, you indicate that you accept these terms of use and that you agree to abide by them. If you do not agree to these terms of use, please refrain from using our site.

ACCESSING OUR SITE
Access to our site is permitted on a temporary basis, and we reserve the right to withdraw or amend the service we provide on our site without notice (see below). We will not be liable if for any reason our site is unavailable at any time or for any period.

INTELLECTUAL PROPERTY RIGHTS
We are the owner or the licensee of all intellectual property rights in our site, and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved. 
You may print off one copy, and may download extracts, of any page(s) from our site for your personal reference and you may draw the attention of others within your organisation to material posted on our site.  
You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.

We aim to update our site regularly, and may change the content at any time. If the need arises, we may suspend access to our site, or close it indefinitely. Any of the material on our site may be out of date at any given time, and we are under no obligation to update such material.

We process information about you in accordance with our privacy policy. By using our site, you consent to such processing and you warrant that all data provided by you is accurate. 

VIRUSES, HACKING AND OTHER OFFENCES

Terms & Conditions for  Users of this website

Accuracy 
The Webmaster of this website cannot accept any legal responsibility for the accuracy of the information on this site or a clients, or any alleged breaches of contract on a clients  part and the client indemnifies The Webmaster of this website against all costs, expenses and losses arising out of a claim relating to the content of a clients website. Clients  should inform us immediately of any material change required.

Liability
The Webmaster of this website does not warrant that the operation of this website site will be uninterrupted or error-free. In no event shall The Webmaster of this website be liable to the advertiser for any special, consequential, incidental or indirect damages, including lost profits. 


WEBSITE DESIGN.

Cassie Marshall Web Design reserves the right to include a credit/link to our website in the footer of any website we have designed.

 Notices required or permitted to be given under these Conditions must be in writing addressed to the relevant party at its registered office or principal place of business.

 Ultimate responsibility for the content of any website or printed material (including text and imagery) is the responsibility of the client. 

One month's notice is required for the termination of any service provided by Cassie Marshall Web Design. 

No waiver by Cassie Marshall Web Design of any breach of the Contract by the Buyer is considered as a waiver of any subsequent breach of the same or any other provision. 

CONTENT
Any photographs or videos taken by a third party must be checked for copywright and distribution must be allowed. We take no responsibility for seeking this permission and therefore we encourage all our clients to get written permission before forwarding any material to us. 

We will not accept any responsibility for content sent to us by the client. all text / imagery / links should be checked by our client before going live by agreeing to these terms and conditions you are agreeing to take ownership of such content. 

PACKAGES
We reserve the right to make changes to our packages / prices and all other parts of our service at any time. 

TIME FRAME
Sites must be completed within 6 months of the deposit being taken. Where it takes longer than 6 months due to the client ( not sending over relevant content, images etc in time ) another 25% deposit will need to be taken should the client wish to still to continue with their site build.

TERMINATION 
Whilst we will always protect content on sites, we use a 3rd party web host. We are protected by them but we always advise clients to make back up copies of all copy given to us. We are not a file storing service and therefore cannot always 100% guarantee your files will not be lost or taken off the internet at anytime.

There is no timescale set on any of our sites and so should the site be removed offline through no fault of our own we wil not be held responsible.  

If any provision of these Conditions is held by a competent authority to be invalid or unenforceable in whole or in part the validity of the other provisions of these Conditions and the remainder of the provision in question is not affected. 

The Contract is governed by the laws of England. The Buyer will submit to the non-exclusive jurisdiction of the English courts.

Payment plans may be available. These will be judged on an individual basis and an amount agreed monthly with both yourselves and us.
 Payment plans will be set up via Direct Debit ( Currently via GO Cardeless www.gocardless.co.uk )every month. Payments plans not paid on the date specified will result in the full outstanding balance being owed immediately and may incur a penalty charge. All payment plans are interest free.

We can never guarantee Google ( or other search engines ) ranking. We will advise and help where possible to improve rankings but ultimately no guarantee can ever be made. 

We use an external web host and CMS software. There may be times when the server will go down which will distrupt your website. This is usually for a very short period of time ( usually 1 hour or less ) We will not be held responsible for any revenue loss due to these disruptions or any longer, permanent disruptions. 


SERVICED SITES
For those sites that are sold as 'Serviced Sites' changes will be free but limited to 1 hours work ( at the discretion of the management ) examples include, change of contact details, uploading up to no more than 10 photographs, a change in text which has been supplied by the customer. If we feel that more than 1 hours work is required a charge of £15.00 per hour will be requested


External links
The Webmaster of this website reserves the right to refuse hypertext links to commercial advertisers, or addresses of, other web sites from advertisers' pages. 

Cancellation / Refund Policy
Your 14 day cooling off period will begin when an agreement ( either by email or verbal agreement ) has been made for us to build and design your site. If you wish to cancel your order please write to info@cassiemarshall.co.uk if within the 14day cooling off period your order will be cancelled and a full refund ( if applicable, not including non refundable 25% deposit ) 
If customers wish to have their Website removed from the Internet before the end of their subscription period ( but after the 14 day cooling off period ), this will be done, but no refunds will be made. 
The Webmaster of this website reserves the right to refuse any advertisement for the web site, and will not be liable for any loss or expense in so doing. 

Privacy 
The Webmaster of this website treats the personal information of site users with the utmost respect and confidentiality and takes reasonable steps to ensure that your personal information is stored securely and accurately. Your personal information will never be provided to any third party for their marketing or promotional use. 

Changes to pricing and conditions 
The Webmaster of this website reserves the right to change the rates and terms and conditions without notice. Any new rates will be applicable immediately for new customers.

Web Hosting
All of our sites now require the client to pay web hosting fees - These may increase or decrease at any time and at least 30 days notice from us, will be given to the client. Price depends on package purchased, please email to confirm price.
